Terms and Conditions

1.Events Beyond Company's Control :

Customer agrees that if the Company is unable to complete the Services by the Completion Date because of reasons that were not caused by the Company (i.e., availability of necessary supplies, specific material required per customer requirement like quality, colour, etc.) or because of events beyond the Company's control (such as fire, flood, acts of God, vandalism, etc.), the Company will not be deemed to have breached this Contract and the time for the Company to complete the Services will be extended by the amount of time reasonably necessary for the Company to complete the Services and at a schedule agreeable to the Parties. The time for the Customer to pay the Company for the Services will be extended in the same manner.

2.Safety Precautions :

The Company will take all reasonable safety precautions in performing the Services. The Company will comply with all applicable laws, ordinances, rules, regulations, and orders of public authorities for the safety of persons and property. The Customer agrees to keep the Property clear of all known and potential hazards. The Customer further agrees to keep all pets out of the work area of the Property.

3. Termination

The Customer can terminate the Contract by giving written notice:

• (a) if the Company commits any material breach of this Contract and fails to correct the breach within 10 days of notice of the breach; or
• (b) if there is any repeated failure by the Company to provide the Services of an acceptable standard and to the reasonable satisfaction of the Customer.

The Company can terminate the Contract by giving written notice:

• (a) if the Customer fails to make the payments required and set forth in Section 4 within 2 days of notice of failure to make a payment; or
• (b) if the Customer commits any other material, non-financial breach and fails to correct the breach within 10 days of notice of the breach.

Refund/Payments

In case of refund/ Payment receivable, the company will ascertain the refund or payment receivable amount based on the products and services pending or rendered from and by client and company after the audit. Default Company activities and materials and important information:

1. Electrical Labour and Electrical Material Charges not mentioned in the quotation subject to until and its discussed and mentioned in above quotation.
2. All Electrical Appliances Such as Lights, Fans, Microwave, Hob, Chimney etc. is not included in Quotation until its discussed and mentioned in above quotation.
3. Painting Charges are not included in the Quotation.
4. False Ceiling Painting only included with just one coat of white paint from company/ Any other colour the client has to bare the charges of the same.
5. By Default false ceiling in quotation is mentioned for only peripheral, please discuss the design with managers and designers and get the revised quotation for the same.
6. Any CNC work in False Ceiling will be charged separately for the CNC work and PVC Ceiling work.
7. Any Change of design on CNC and Glass has to be discussed before processing, anything after the processing is charged separately and payment for the same has to be made immediately.
8. Any changes in middle of the work will be changed separately apart from quoted amount and need to make the payment immediately.
9. 18% GST levied on CenturyPly, GreenPly, ArchidPly, Kitply as mandatory, kindly discuss with the managers for the same.
10. 10.We use ISI Marked, Termite free 18mm MR Calibrated Plywood for all the furniture? s by default.
11. 11.BWR 18mm Ply is used in Kitchen base units and wall unit area and all wet areas by default.
12. All CNC cutting in false ceiling and Pooja Unit will be of MDF/Pre Laminated sheets of Plywood.
13. 1mm Matte/Glossy laminates used in all External Lamination, Any other laminate eg: Acrylic, PVC, Lacquered will cost extra.
14. White Laminate will be used inside lamination. Any other colour Laminate or fabric textured inside will cost 6000 Extra on Quotation.
15. Kitchen accessories are from innovative or Ebco only.
16. All the Hinges are from Ebco only by default.
17. Hinges from Haffele or Hettich will attract extra charges the difference between ebco and other brands had to be paid by the client.
18. By Default we will be providing 4 sets of SS 304 wired baskets and 2 Tandem Boxes, G Profile Handles and soft closures hinges and hydraulics for lift ups if any, any other accessory in kitchen will attract extra charges apart from 42,000.
19. If Project delayed beyond 50 working days after 1st instalment, company will compensate half of the rent of the flat client staying in or maximum upto 7,500 rupees.
20. Wardrobes either hinged/sliding will have just 4 drawers by default as presented.
21. Any extra drawers and sections will attract extra charges.
22. All sliding Wardrobes will be installed with Soft closing mechanism.
23. Wardrobe inner design will be a standard design two hangers, four drawers and two shelves (change of design may be charged extra)
24. Use of PVC G profile for kitchen Handles (Aluminium G profile will cost extra)
25. All Handles with other design and premium quality to be purchased from owners end as they are not included in Quotation. Company provides default designs itself and won't be changed extra if chosen from the default designs handles.
26. Any work or material beyond our standard quality maintenance will cost more and has to be borne by the owner.
27. Soft closing Hinges are only in Kitchen base unit and upper unit, anywhere else apart from this will cost you extra on MRP of Hinge.
28. All the 3D designs and Rendering will cost extra as per the Sq.ft/Products Covered.
29. Delay in payment and selection of materials and designs will lead to delay in delivery timeline extension equivalent to the delay and client will not be benefitted with delay compensations.
30. Any Delays caused due to Lockdown, Strike, Act of god, Non Payment which are not under the control of company has to be co operated by client.
31. Premises keys will be handed over to the owner on the day of final settlement.
32. Avoid direct discussion to onsite workers due to miss communication between company and client, Use of Message centre is highly recommended for faster resolution.
33. All the communication should happen from your dashboard Message centre only or authentic company created whatsapp group.
34. On any Doubts and clarifications company representative or POC will be helpful to you always, do not take advises or instructions from others.
35. Any Changes to the project after consent form signing will take time more than delivery committed time.
36. Any changes to the project in between the payment have to be made immediately
37. Handles and Knobs designs has to be selected from the shared catalogue, any premium design handles to be installed the client has to bare the charges.
38. Diamond shape mirror in decoration by default normal glass are included, if any other colour such as Bronze colour, Rose gold will charge extra until it is discussed and mentioned in the quotation.
39. All the prices we mention are with material, labour, installation of material and transportation (Extra transportation charges will be added for the projects beyond the city limit).
40. Electrical works complain and concerns only considered from electrician in furniture and false ceiling, any other electrical work got it done from vendor company is not responsible.
41. Any extra work apart from in quotation got it done from onsite workers without company knowledge will void the warranty and extra work will be charges during the audit and same has to be settled in final settlement.
42. All the changes and communication has to be done to company itself on Message centre, whatsapp group or CSR team only.
43. Work procedure:
    a.False Ceiling (If opted from company)
    b.Electrical (if opted from company)
    c. Woodworkd. Granite, CNC, Lights, Tiles, Etc. (if Opted any)
44. We do not charge anything extra apart from the quoted amount signed for the furniture or products opted in, Any Thing extra shall be chargeable and has to be transferred with company's knowledge
45. Request Clients to contact only POC assigned or Designers or in a WhatsApp group.
46. Request clients do not discuss the financial transaction with the workers and employess.
47. Keys of the flat will be handed over to the client back only after final settlement.
48. Final Settlement has to be done to the executive onsite before we leave the site.
49. If any changes or requirements discussed with anyone has to be posted in notes or Comments.If not mentioned then it considered as invalid and will not be executed kindly check the same before accepting the quotation.
50. Initial Quotation is actual quotation and measurements and requirements may vary from factual requirements which will be done only after site Visit and laser measurements.
51. Any changes in lamination colour or material after the procurement charges has to be barred by the client.
52. Every Detail Published on the quotation has been considered based on the discussion, if anything is missing kindly get the things updated before signing the consent form.
53. 54.Once consent form is signed there will not be any changes from company side nor if any changes have to be done it has to be mentioned to your project manager.
54. All the lofts will be installed with normal hinges.
55. 56.External Sliding channels like Topline 22 for wardrobes will cost extra please discuss with your managers on designs and mechanism before consent form signatures else we will consider default materials.
56. 18mm termite free calibrated Plywood, 1mm Matte/Glossy Laminate externally, and 0.8mm Laminates internally.
57. Company will be providing 4 sets of Kitchen baskets of Innovative Brand and PVC Cutlery Tray, and 2 Sets of Tandem Boxes anything extra beyond is chargeable to client.
58. Soft Closing Hinges in Kitchen base unit and upper unit and normal hinges in lofts, TV unit and other products. All wardrobes external doors will be installed by soft closure hinges or Sliders.
59. Door edge banding will be provided with 2mm thickness.
60. All internal lamination will be of white colour, changing to colour inner laminate will attract extra charges.
61. False ceiling will be done with Saint Gobain Gyproc Boards.
62. All electrical and electronics will not be included in the quotation such as wiring, fixing, lights, machines, devices, fridges, hob, chimney etc or its labour. Until agreed while the time of quotation finalization which is attached with this document.
63. Granite/Quarts/Sand work, stone work, tile work, civil work also not included in the quotation attached.
64. If Project failed to complete before 45 days from the date of first payment company will bare the half of the rent upto Rs. 7,500, of the present stay(Upon submitting the rental document signed by the owner of the flat)
65. Any sort of misbehaviour/ Unprofessional behaviour of customer with the staff will lead to termination of the contract.
66. If anything extra work/Product beyond the quotation entry will attract extra charges and has to be paid immediately.
67. Failing to make the payment upon 3rd Reminder to the client, work will be stopped immediately to stop the fraudulent practice.
68. Common sink/basin design has to be selected first as every design has different prices.
69. BWP wood will be installed in kitchen area or wet area only.
70. Any design change after final approval and if the design makes the work double or require extra wood has to be borne by the owner/customer.
71. CNC work design once selected cannot be changes until client is ready to make payment.
72. Wall Paint and CNC and any design or colours has to be selected by the client itself. Any changes customer need to bare the extra charges.
73. False ceiling will be painted only with white colour from company, any other colour the client has to bare the expense
74. Ceramic Sinks are liable to only as per company expense if mentioned in Quote any other designer Sinks or Bowls the client has to pay the extra charges on procurement or require extra wood has to be borne by the owner/customer.
75. CNC work design once selected cannot be changes until client is ready to make payment.
76. Wall Paint and CNC and any design or colours has to be selected by the client itself. Any changes customer need to bare the extra charges.
77. False ceiling will be painted only with white colour from company, any other colour the client has to bare the expense.
78. Ceramic Sinks are liable to only as per company expense if mentioned in Quote any other designer Sinks or Bowls the client has to pay the extra charges on procurement.
79. 76.Having personal conversation and deals with onsite labours or staff without company's knowledge will lead to Warranty void for the complete project as part of safety concerns and due to chances of compromises in Material and labour may get involved, and hence company will not bare any such mistakes or losses occurred due to direct labour involvement.
80. Always reach out to customer support or your concerned project managers in any such instances.

Entire Agreement

This document reflects the entire agreement between the Company and the Customer and reflects a complete understanding of the parties with respect to the subject matter. This Contract supersedes all prior written and oral representations. The Contract may not be amended, altered or supplemented except in writing signed by both the Company and the Customer.

Dispute Resolution and Legal Fees

In the event of a dispute arising out of this Contract that cannot be resolved by mutual agreement, the Parties agree to engage in mediation. If the matter cannot be resolved through mediation, and legal action ensues, the successful party will be entitled to its legal fees, including, but not limited to its attorneys fees.

Legal and Binding Contract

This Contract is legal and binding between the Parties as stated above. This Contract may be entered into and is legal and binding in India. The Parties each represent that they have the authority to enter into this Contract.

Severability

If any provision of this Contract shall be held to be invalid or unenforceable for any reason, the remaining provisions shall continue to be valid and enforceable. If the Court finds that any provision of this Contract is invalid or enforceable, but that by limiting such provision it would become valid and enforceable, then such provision shall be deemed to be written, construed, and enforced as so limited.

Waiver

The failure of either party to enforce any provision of this Contract shall not be construed as a waiver or limitation of that party's right to subsequently enforce and compel strict compliance with every provision of this Contract.

Applicable Law

This Contract shall be governed and construed in accordance with the laws of the state where the Property is located, without giving effect to any conflicts of law's provisions. The Company is complete responsible for any monetarily loss or incompletion of the work at the customer place and has to bear and will be held for any complaints.
